Welcome to the Ksloir in the Sky website! These terms and conditions (the "Terms") govern your use of our website and any purchases/bookings made through our website. By accessing our website and making a purchase/booking, you agree to be bound by these Terms. Please read these Terms carefully before making any purchases/bookings.

Liability Clause

The customer agrees that we shall not be liable for:

  • any delays in the delivery and/or non-delivery of any seat confirmation

  • anything affecting the production of an event due to an act of God, action by any government entity, electronic malfunction, or any condition beyond our control.

  • consequential damages of any nature whatsoever. Under no circumstances will we be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or related to your purchase of a seat, even if such damages are foreseeable and whether or not we have been advised of the possibility thereof. Our liability hereunder shall not exceed the price of the seats purchased by you.

Cancelling or Re-scheduling of Event

It is your responsibility to ascertain whether the event has been cancelled or rescheduled and to know the date and time of any rescheduled event. In the event of a cancellation or rescheduling, the organizer will use their best efforts to notify you.

There is no fee to reschedule, subject to the terms and conditions. Rescheduled tickets must be booked within 12 months of the original ticket purchase date. If the ticket purchase date exceeds 12 months, the purchased ticket will be deemed invalid, and no refund will be given.

In the event of a guest failing to show up (no show), the ticket will be considered forfeited, and no refund will be applied.

Transaction Currency

All transactions on this website use the United States Dollar (USD).

Use of details and data
Information is collected from those registering in the system in order to facilitate seat purchases or other services available.

Conditions of Admission

  • The guest must meet the minimum height of 4ft 5 inches to attend a Dinner in the Sky event. If guests are below 18 years old, they are required to be with an adult. (The adult accompanying the guest should be minimum of 18 years old).

  • Punctuality is very important for the Dinner in the Sky Jamaica experience. You are advised to arrive at least 1 hour before the scheduled time as designated by your seat confirmation. If there is a delay on your arrival, and the platform has already been lifted, the Organizer will not lower the platform for you, and your seat will be cancelled automatically, with no refund given.

  • You are advised to dress accordingly to the weather. Please be advised that at 45 meters in height, the wind can be stronger, and the temperature can be lower than usual. Once the platform has already been lifted, the organizer will not lower the platform for you if you request to change your attire, shoes, etc.

  • The Organizer cannot guarantee that participating chefs and restaurants will prepare dishes without common allergens, such as nuts, dairy, gluten, etc. You are advised to go through the menu on our website before purchasing a seat. You shall be responsible for your own health and safety and shall observe any and all precautions regarding your medical condition, inter alia diabetes, food allergies etc, without any recourse towards the Organizer. If you have any food allergies, kindly state that in your online booking or by sending us an email to info@ksloirinthesky.com

  • The Organizer reserves the right to refuse or deny your admission to the venue in reasonable circumstances, including health and safety matters, licensing reasons or where a seat is void. The Organizer also reserves the right to request you to leave the venue at any point in time on any reasonable grounds and may take any appropriate action to enforce this right.

 

By way of example, the Organizer may remove anybody who:

  • behaves in a manner which, in the reasonable opinion of the Organizer, has or is likely to affect the enjoyment of other customers; or

  • uses threatening, abusive or insulting language or behaviour or in any way provokes or behaves in a manner which may disturb the peace of other customers; or

  • in the reasonable opinion of the Organizer, you are acting under the influence of alcohol or drugs.

 

  • You must comply with the instructions and directions given by the Organizer, the staff and the stewards on duty. No refunds will be given to those who have been denied entry due to their own behaviour, as suggested in, but not limited to, the examples above.

  • You voluntarily assume all risk and danger incidental to the event, whether occurring prior to, during or subsequent to the actual event, including any death, personal injury, loss, damage or liability.

  • Dinner in the Sky Jamaica does not limit in any way the participation of any disabled person, but the said individual MUST provide sufficient information (in writing) regarding their medical condition to the organizer prior to purchasing a seat. The organizer will then assess the situation, and officials trained in safety experience will decide whether the individual may or may not participate.

  • The health and safety of our customers are our number one priority.

Safety Rules for the event

  • The Organizer has the discretion to decide on the height of the table once it is lifted, based on the recommendation from our safety officer on any particular day or time.

  • In the case of adverse weather conditions, the Organizer has the right to delay the dining session (at the organizer’s discretion but with a maximum delay of 1.5 hours only with no refund). If the condition of the weather does not improve, the dining session will be cancelled and you will be issued a full refund within 14 business days, or you will be issued a voucher with the same value of money to be used in USD within the current event duration.

  • For safety reasons, you must be at least 4ft 5 inches in height and with a maximum weight of 300 lbs to enjoy the Dinner in The Sky.

  • We strongly suggest avoiding wearing open-toe shoes or shoes without laces on the day of the event.

  • Safety belts are for your protection. Leave them on as they are, and do not try to remove them at any point during the dining session. If safety belts are removed, the table will be lowered, and you will be asked to exit the platform.

  • It is strictly forbidden to throw anything from the table at any time. Failure to adhere to this condition will lead to ejection, and you shall be asked to leave the venue at any point in time, with no refund given.

  • Smoking is strictly prohibited at Dinner in the Sky Jamaica except in the designated smoking area. Failure to adhere to this condition will lead to seat purchasers being asked to leave the venue at any point, with no refund given.

  • Only small items such as cell phones or cameras will be allowed to be brought along with you to the table during the dining session. Lockers will be provided for large items such as handbags. It is your responsibility to keep your personal belongings like cell phones and cameras safe. The organizer is not to be held responsible for the damage or loss of your items, if any.

  • You are obliged to adhere to and obey any instructions given by the staff of Dinner in the Sky Jamaica at all times. Touching any operational devices or machinery is strictly prohibited and may result in legal actions taken.

Restrictions and Prohibitions

  • The Organizer reserves the right to use any photograph/video taken at any Dinner in The Sky® event without the expressed written permission of those included within the photograph/video. The Organizer may use the photograph/video in publications or other media material produced, used or contracted by the organizer, including but not limited to: brochures, invitations, books, newspapers, magazines, television, websites, etc.

  • Any person desiring not to have their photo taken or distributed must inform the Organizer in writing of his/her intentions and include his or her photograph. The Organizer will use the photo for identification purposes and will hold it in confidence.

 

The following are not permitted within any venue:

  • Animals

  • Your own food and drink (unless permitted by the Organizer)

  • Bottles, cans or glass containers (unless permitted by the

  • Organizer)

  • Any item which may be interpreted as a potential weapon including sharp or pointed objects (e.g., knives)

  • Illegal substances

  • Professional/ commercial recording devices

  • Firearms or weapons

 

You are agreeing to follow directions given by authorized personnel of the Organizer to submit any search for prohibited items, including weapons, controlled/dangerous and illegal substances.

The Organizer, the venue owner, the sponsors, the contractors, their agents and employees shall not be liable for any death, personal injury, loss or damage caused while at the venue or during the Event, nor are they liable for any postponement of the dinner. The seat purchaser is purchasing and accepting the seat voluntarily and assumes all risk and danger incidental to the event, whether occurring prior to, during or subsequent to the event, including death, personal injury, loss, damage and liability.

Weather Conditions

  • The organizer has the right to postpone the session for 90 minutes due to bad weather, and it will not be considered a cancelled session, with no refund.

  • The Organizer has the full rights to cancel the Dinner In the Sky experience due to bad weather (Customers will be issued a refund within 14 business days only for bad weather conditions).

 


Refunds

  • Seats, add-ons and upgrade services purchased cannot be refunded, exchanged or cancelled once issued except in the event of a cancellation by the Organizer themselves.

  • The Organizer has the full right to cancel the Dinner In the Sky experience due to bad weather.

  • If an event is cancelled by the Organizer, the following situation will take place: For ONLINE credit or debit card purchasers, we will work with your respective card’s banks to automatically credit the amount back onto your card. This process takes approximately 14 business days after the Event.

Cancellation Insurance
We recommend buying cancellation insurance for Jamaica’s visitors or tourists staying for a limited period of time.


With the purchase of the cancellation insurance, if you wish to cancel your reservation session for any reason, it must be at least 24 hours prior to your reservation time, and we will issue you a full refund.


Without adding the cancellation insurance, no refund will be granted if you should cancel your reservation; only a date change will be given, not to exceed 1 year.

Safety & Security

Absolutely no firearms or weapons of any kind are allowed at the Dinner in the Sky Jamaica Venue. Safety for our guests is our number one priority.

​

Dinner in the Sky is a product developed by E.I.T.S. BvBa according to 2 Golden Words: Exclusivity and Safety

 

Dinner in the Sky is designed according to German norm DIN 4112, flying structures - guidelines for the calculation and execution, with all drawings, calculations and simulations tested by TÜV Rheinland. Platforms are built in Belgium and are regularly checked and maintained. Every aspect of the concept, from the seat belts to the type of crane used, has been scrutinized and carefully considered to ensure maximum safety for our clients and employees.


While seated guests wear safety belts, standing presenter and crew are secured by safety harnesses all the time during the flight. A safety supervisor will brief clients about all safety regulations prior to the flight and will be in constant communication with the crane operator and ground crew so that he has a complete picture of the situation during the operation.


The company gives painstaking attention to every detail in order to maximize security and ensure guests always feel safe. 


This obsession with safety is one of the reasons why Dinner in the Sky is now operated in over 66 countries and gained official authorization from the toughest nations, including US, Canada, Australia, South Africa, Germany and now Jamaica.

Security Policy

We encrypt certain sensitive information (such as credit card information) using Secure Sockets Layer (SSL) technology to ensure that your Personally Identifiable Information is safe as it is transmitted.

Amendments

We reserve the right to modify these Terms at any time without prior notice. Any changes to these Terms will be posted on our website, and your continued use of our website after such changes have been posted constitutes your acceptance of the revised Terms.
